Terms and Conditions for Using Maybank Credit Card

These Terms and Conditions for Using Maybank Credit Card constitute an agreement between the Maybank Credit Card holder and Maybank. Before using the Maybank Credit Card, the cardholder is required to first read and understand the terms and conditions as outlined in these Terms and Conditions for Using the Maybank Credit Card. By using the Maybank Credit Card, the cardholder confirms that they have read, understood, accepted, and agree to be bound by these terms and conditions. If there are any matters that require further clarification regarding the Maybank Credit Card or the Terms and Conditions for Using the Maybank Credit Card, please contact Maybank Customer Care at 1500611 or +6221 78869811 (from abroad).

  1. Definitions
    1. Maybank refers to PT Bank Maybank Indonesia Tbk, a limited liability company that is licensed and supervised by the Financial Services Authority (Otoritas Jasa Keuangan), and all products or services issued by Maybank are in compliance with applicable laws, particularly in the financial services sector.
    2. Maybank Credit Card (hereinafter referred to as "Credit Card") is a payment tool in the form of a credit card, either in physical and/or virtual form, that can be used to make payments for obligations arising from economic activities, including shopping transactions and/or for cash withdrawals. The payment obligation of the Credit Cardholder is initially fulfilled by Maybank, and the Credit Cardholder must repay the amount at the agreed time, either in full or by installment. The types of Credit Cards issued by Maybank include Maybank Visa Credit Card, Maybank Mastercard® Credit Card, and other Maybank Credit Cards that may be established from time to time.
    3. Cross Default refers to a right possessed by Maybank if, in Maybank's view, there is a situation where the Credit Cardholder and/or their guarantor fails to fulfill any obligation or breaches the terms of another agreement made between Maybank and the Credit Cardholder and/or their guarantor. In such cases, Maybank has the right to declare that the Credit Cardholder has automatically defaulted or violated the terms of these Terms and Conditions.
    4. Credit Card Usage Documents refer to all and any operational documents related to the use of the Credit Card between Maybank and the Primary Credit Cardholder, including but not limited to the Maybank Credit Card Application Form, documents in the Welcome Package, the Credit Card Carrier, and Billing Statements.
    5. Business Day refers to any day when Maybank conducts national clearing transactions.
    6. Primary Credit Card refers to the Credit Card issued by Maybank to the Primary Credit Cardholder.
    7. Supplementary Credit Card refers to the Credit Card issued by Maybank to a Supplementary Credit Cardholder based on a request from the Primary Credit Cardholder.
    8. Merchant refers to the seller of goods and/or services that accepts payments from Credit Card transactions.
    9. One-Time Password (OTP) refers to a specific password/code sent by Maybank to the Credit Cardholder via SMS or another medium determined by Maybank. The Credit Cardholder is required to enter the OTP whenever making an online Credit Card transaction.
    10. Credit Cardholder refers to both the Primary and Supplementary Credit Cardholders.
    11. Primary Credit Cardholder refers to the authorized user whose name is printed on the Primary Credit Card. The Primary Credit Cardholder may apply to Maybank to designate another party to use/enjoy the benefits of the Credit Card.
    12. Supplementary Credit Cardholder refers to the authorized user whose name is printed on the Supplementary Credit Card. The Supplementary Credit Cardholder is a person approved by Maybank based on a request from the Primary Credit Cardholder to use/enjoy the benefits of the Primary Credit Card.
    13. Billing Statement or also known as Billing Statement refers to the information regarding the details of the outstanding balance that must be paid by the Credit Cardholder related to the use of the Credit Card.
    14. Cash Advance refers to cash withdrawals made by the Credit Cardholder using the Credit Card. Withdrawals can be made by the Credit Cardholder at Maybank branches or ATMs, other ATMs with Visa/Mastercard®/JCB licenses, or at other locations notified by Maybank from time to time.
    15. Credit Card Limit refers to the maximum limit of Credit Card usage granted by Maybank to the Credit Cardholder.
    16. Personal Identification Number (PIN) refers to a confidential identification number given by Maybank, which is known only to the Credit Cardholder and must not be shared with others.
    17. Due Date refers to the date when the payment for the Credit Card billing is due by the Primary Credit Cardholder. The Due Date is stated in the Billing Statement.
    18. Billing Date refers to the date when the transactions and the outstanding balance from Credit Card usage are billed.
    19. Outstanding Balance refers to the amount owed on the Credit Card at the Billing Date, which includes the previous month's outstanding balance, transactions up to the Billing Date, fees, and interest, minus payments and credits.
    20. Terms and Conditions refers to these Terms and Conditions for Using the Credit Card, including any amendments, additions, or attachments, whether existing or introduced in the future, as determined by Maybank and communicated to the Credit Cardholder from time to time.
    21. Sales Draft refers to a document that serves as evidence of a Credit Card transaction with a merchant or with another third party.

  2. Validity of Terms and Conditions and Its Changes
    1. By activating and/or using the Maybank Credit Card and as long as the Maybank Credit Card is still used by the Credit Cardholder, the Credit Cardholder agrees and is bound by these Terms and Conditions.
    2. Maybank has the right to modify, reduce, or add requirements or provisions in these Terms and Conditions, including but not limited to the amount of fines, administrative fees, Credit Card Limit, and the minimum payment amount. These changes will take effect once they are made, with prior notice to the Primary Credit Cardholder at least 30 (thirty) Business Days in advance. The notice will be delivered using a medium or method that is legally permitted and/or deemed appropriate by Maybank.
    3. If the Credit Cardholder disagrees with the changes/reductions/additions to these Terms and Conditions as referred to in Article II.2, the Credit Cardholder may contact Maybank.

  3. Annual Fee
    1. The Credit Cardholder agrees to pay the annual fee for the use of the Maybank Credit Card. The annual fee that has been paid cannot be refunded.
    2. The amount of the annual fee is determined by Maybank and will be billed along with the Billing Statement.

  4. Issuance, Ownership, and Use of the Credit Card
    1. The issuance of the Maybank Credit Card is carried out by Maybank once the requirements set by Maybank have been fulfilled.
    2. The Credit Card may only be used by the Credit Cardholder and cannot be transferred and/or pledged for any reason and to anyone. If the Credit Card is used by someone other than the Credit Cardholder, the Credit Cardholder will bear all risks arising from such use and will indemnify Maybank from any responsibility related to the Credit Cardholder's actions.
    3. Maybank will issue a PIN to the Credit Cardholder so that the Credit Cardholder can make Credit Card transactions that require a PIN, such as transactions at merchants/ offline transactions. In addition to the PIN, Maybank will also issue an OTP, which the Credit Cardholder needs to perform online Credit Card transactions. The Credit Cardholder must maintain the confidentiality of the PIN and OTP and is fully responsible for any use or misuse of the PIN or OTP. The Credit Cardholder will indemnify Maybank for any claims or lawsuits arising from the misuse of the PIN or OTP by the Credit Cardholder.
    4. The Primary Credit Cardholder is responsible for all transactions made using the Primary Credit Card and Supplementary Credit Card.
    5. The Credit Card can be used as a payment tool with Merchants as long as it is still valid and there is an unused Credit Card Limit available. The Credit Card can also be used to withdraw cash from ATMs within the cash withdrawal limits set in Article VI.4.
    6. The Primary Credit Cardholder is responsible for each and every Credit Card transaction, including those made by the Supplementary Credit Cardholder, including in the event that the Primary or Supplementary Credit Card is lost or misused for any reason.
    7. In accordance with the principles of prudence and risk management, Maybank has the right to request the Credit Cardholder to return the Credit Card to the bank. If the Credit Card is not requested back by Maybank, and the Credit Cardholder intends to stop using the Credit Card, or if the Credit Card has expired, the Credit Cardholder must immediately destroy or cut the Credit Card into two parts, making sure to damage the chip and magnetic stripe of the Credit Card.
    8. The validity of the Credit Card may be automatically extended based on Maybank's approval, unless there is a cancellation/termination request from the Primary Credit Cardholder or a restriction on the use of the Credit Card in accordance with applicable regulations.
    9. All Credit Card transactions will be billed by Maybank to the Primary Credit Cardholder in Indonesian Rupiah. Credit Card transactions made in foreign currencies will be converted into Indonesian Rupiah based on the exchange rate applicable at Maybank at the time the transaction is posted. The Credit Cardholder understands that (i) the conversion may be made by Maybank according to its policy, and (ii) Maybank is not required to notify or obtain prior approval from the Credit Cardholder.
    10. The Credit Cardholder must keep a copy of the Sales Draft or invoice/transaction slip to verify the calculations stated in the Billing Statement. If the data on the copy of the Sales Draft or invoice/transaction slip differs from the data held by Maybank, the data held by Maybank will prevail.
    11. The Credit Cardholder is responsible for any issues or disputes related to the purchase of goods/services obtained through Credit Card transactions. If any claims or disputes arise with the Merchant, the Primary Credit Cardholder is not entitled to refuse payment for the related transactions.
    12. The procedure for using the Credit Card in a contactless manner can be found on the Maybank website: maybank.co.id/contactless, which forms an integral part of these Terms and Conditions.

  5. Activation of Virtual Credit Card
    1. A Virtual Credit Card refers to a Credit Card whose application is made through the M2U ID application.
    2. The activation of the Virtual Credit Card by the Credit Cardholder is entirely the responsibility of the Credit Cardholder. The Credit Cardholder understands: (i) the consequences that may occur after the activation process, (ii) any risks that may arise and become the responsibility of the Credit Cardholder if the physical Credit Card has not yet been received.

  6. Cash Advance
    1. A Cash Advance can be made at ATMs displaying the Cirrus, ALTO, ATM Bersama, and Prima logos using a PIN, both within Indonesia and abroad.
    2. Cash Advances will be subject to administrative fees and interest, the amounts of which will be determined by Maybank and communicated to the Primary Maybank Credit Cardholder from time to time.
    3. The interest mentioned in Article VI.2 will be calculated from the date of the Cash Advance until the payment is made.
    4. Unless specifically stated by Maybank, the maximum Cash Advance limit is as follows: i. Up to 60% of the Credit Card limit. The Primary Maybank Credit Cardholder will incur administrative fees and interest calculated from the date of the Cash Advance until the Payment Date; or ii. Up to the remaining Credit Card limit; or iii. A specific amount determined by Maybank.
    5. The maximum Cash Advance limit, administrative fees, and interest will be determined by Maybank and communicated to the Primary Maybank Credit Cardholder and/or the Supplementary Maybank Credit Cardholder through the Billing Statement.

  7. Cash Withdrawal
    1. Cash Withdrawals can be made at ATMs with the Cirrus, ALTO, ATM Bersama, and Prima logos using a PIN, both within Indonesia and abroad.
    2. A cash withdrawal will be subject to an administrative fee and interest, the amount of which will be determined by Maybank and communicated to the Primary Credit Cardholder from time to time.
    3. The interest referred to in Article VI.2 will be calculated from the date of the cash withdrawal until the date of payment.
    4. Unless explicitly stated otherwise by Maybank, the maximum amount for Cash Withdrawals is: I. 60% of the Credit Card limit. The Credit Cardholder will be charged an administrative fee and interest calculated from the date of withdrawal until the Payment Date; or II. The remaining Credit Card limit; or III. A specific amount determined by Maybank.
    5. The maximum amount for Cash Withdrawals, administrative fees, and interest will be determined by Maybank and communicated to the Primary Credit Cardholder and/or Supplementary Credit Cardholder through the Billing Statement.

  8. Bill Payment and Transaction Details
    1. Maybank will first pay the Merchant or another bank for all Credit Card transactions based on the Sales Draft or billing list submitted to Maybank. The Credit Cardholder is responsible for the amounts stated in the Sales Draft or billing list.
    2. The Billing Statement will be sent by Maybank to the Primary Credit Cardholder and/or Supplementary Credit Cardholder each month, or at other times as deemed necessary by Maybank. The Billing Statement will not be sent if there is no outstanding balance or if there has been no payment (either partial or full) for the outstanding balance after three consecutive Billing Statements have been sent to the Primary Credit Cardholder and/or Supplementary Credit Cardholder.
    3. Failure to receive the Billing Statement does not relieve the Primary Credit Cardholder and/or Supplementary Credit Cardholder from their obligation to pay the due amounts.
    4. If requested by the Credit Cardholder, Maybank may provide a copy of the Billing Statement for up to the last 12 months.
    5. The Credit Cardholder is required to make payment/settlement for the Credit Card usage as stated in the Billing Statement.
    6. The charges for the usage of both the Primary Credit Card and the Supplementary Credit Card are the responsibility of the Credit Cardholder to Maybank. The charges incurred by the Supplementary Credit Cardholder will be billed to the Primary Credit Cardholder and included in the Primary Credit Cardholder's billing statement.
    7. If the Supplementary Credit Card is canceled, all outstanding charges for the Supplementary Credit Card transactions will be transferred to and become the responsibility of the Primary Credit Cardholder.
    8. If requested by the Credit Cardholder, Maybank may provide a copy of the Sales Draft according to Visa/Mastercard®/JCB terms and will charge an administrative fee to the Credit Cardholder, the amount of which will be notified from time to time by Maybank.
    9. Payment should be made before the Due Date to avoid late payment fees. Payments must include the Credit Card number as stated in the Billing Statement or on the Credit Card and can be made using one of the following methods: i. Cash payment through deposits at all Maybank branches. ii. Payment via Giro/Cheque should be made 3 (three) Business Days before the due date. iii. Payment via LLG transfer directed to Maybank Card Center, Sentral Senayan 3 Building, Jl. Asia Afrika No.8, Jakarta 10270. iv. Debit of Maybank or other bank accounts based on the Credit Cardholder's debit authorization. v. Debit from the Maybank account of the Credit Cardholder will be done automatically on the due date for the total Credit Card bill. A written statement from the Credit Cardholder is required for debit of the minimum payment amount as indicated on the billing statement. vi. Payment via Maybank ATM if the Credit Cardholder has a Maybank ATM Card or Credit Card account. vii. Payment via Maybank Premium Call (Phone Banking) if the Credit Cardholder has a Maybank ATM Card or Credit Card account. The Phone Banking PIN can be obtained through Maybank ATM. viii. Payment via Maybank Internet Banking if the Credit Cardholder has a savings/checking account at Maybank. ix. Payment via other bank ATMs cooperating with Maybank, no later than 3 (three) Business Days before the due date. x. Payment via other banking media or facilities as informed by Maybank from time to time.
    10. Payments may also be made according to other methods specified in the Billing Statement.
    11. Payment settlements made by cheque/giro (Maybank or other banks) or other banking media will only be considered settled once the funds have been effectively received by Maybank.
    12. All fees related to payment settlement will be deducted from the outstanding balance. If a cheque/giro is rejected, the Primary Credit Cardholder will be charged an administrative fee as specified in the Billing Statement.
    13. The Primary Credit Cardholder agrees that Maybank has the right to use third-party services to collect payments in a way that Maybank deems appropriate to ensure the Credit Cardholder settles all obligations arising from the Credit Card in case the Credit Cardholder's credit quality is categorized as Delinquent.
    14. Maybank will account for excess payments made by the Credit Cardholder towards future Credit Card usage or transactions. A refund for the excess payment will only be made by Maybank if requested by the Primary Credit Cardholder.
    15. If the Credit Cardholder fails to fulfill their payment obligations, the Credit Cardholder grants Maybank the authority to:
      1. Block and/or cancel and/or temporarily freeze the Credit Card, either temporarily or permanently;
      2. Debit the Credit Cardholder's account or liquidate any collateral against the credit facility with Maybank by debiting all collateral and/or savings of the Credit Cardholder and/or guarantor (if any) in the savings, current, and/or deposit accounts with Maybank, both existing and future, to settle or pay off all Credit Card obligations;
      3. Call the Credit Cardholder and/or guarantor (if any) via mass media;
      4. Collect payments through third-party services if the credit quality is categorized as delinquent;
      5. File for bankruptcy against the Credit Cardholder and/or guarantor (if any);
      6. Declare the Credit Cardholder in default for failing to fulfill obligations arising from other agreements with Maybank;
      7. Take any other actions deemed necessary by Maybank for effective debt collection.

  9. Minimum Payment, Interest, and Other Fees
    1. The amount of the minimum payment on the Outstanding Balance can be seen in the Billing Statement.
    2. Maybank will not charge interest if the Credit Cardholder fully settles the Outstanding Balance as stated in the Billing Statement, and Maybank receives the payment no later than the Due Date.
    3. If the Credit Cardholder does not pay the full Outstanding Balance by the Due Date, interest and penalties will be added to the following billing cycle.
    4. Interest on credit card transactions will be charged to the Credit Cardholder if:
      1. The payment is received by Maybank after the Due Date;
      2. A Cash Advance is made;
      3. The payment is not received by Maybank;
      4. The payment is partial or less than the Outstanding Balance.
    5. Interest will be charged monthly based on the daily Outstanding Balance, with interest calculated from the date the transaction is posted by Maybank until the full Outstanding Balance is paid by the Primary Credit Cardholder. The interest rate can be found on the Billing Statement.
    6. Late Payment Fees: The Credit Cardholder will incur a late payment fee, the amount of which can be seen on the Billing Statement. Late fees will be applied if:
      1. Payment is made after the Due Date;
      2. Payment is less than the minimum payment;
      3. No payment is made.
    7. Over-Limit Fee: The Primary Credit Cardholder will be charged a fee if they exceed the Credit Limit set on their Credit Card. The fee amount can be found on the Billing Statement.
    8. Other Fees: Other fees related to Credit Card transactions can be seen on the Billing Statement.
    9. Legal and Collection Fees: If due to any legal requirement, Maybank is required to pay fees related to the Credit Card, including collection fees by third parties acting as Maybank's agent, these costs will be charged to the Credit Cardholder.
    10. Changes to Minimum Payments, Interest Rates, and Other Fees: If Maybank changes the minimum payment amount, interest rates, or other fees, Maybank will notify the Primary Credit Cardholder in advance, at least 30 (thirty) Business Days before the changes take effect, or sooner if required by regulatory provisions.
      1. Impact on Credit Reporting: According to applicable banking regulations, any delay in payment by the Credit Cardholder will affect the credit quality/collectibility report of the Credit Cardholder. Maybank is required to report the Credit Cardholder’s credit quality/collectibility status to Bank Indonesia. The status and consequences of the credit quality/collectibility classification as regulated by Bank Indonesia are as follows:
      2. Lancar (Current): Payments are made on time, and there are no outstanding balances.
      3. Dalam Perhatian Khusus (Special Attention): There is a delay in payment of the principal and/or interest on the Credit Card bill for up to 90 (ninety) calendar days. In this case, Maybank will exercise its rights under these Terms and Conditions, including sending warning letters and performing collection actions through any communication media and/or officers designated by Maybank.
      4. Kurang Lancar (Less Than Current): There is a delay in payment of the principal and/or interest on the Credit Card bill for more than 90 (ninety) calendar days but less than 120 (one hundred twenty) calendar days. In this case, Maybank will exercise its rights under these Terms and Conditions, including sending warning letters and performing collection actions through any communication media and/or officers designated by Maybank.
      5. Diragukan (Doubtful): There is a delay in payment of the principal and/or interest on the Credit Card bill for more than 120 (one hundred twenty) calendar days but less than 180 (one hundred eighty) calendar days. In this case, Maybank will exercise its rights under these Terms and Conditions, including sending warning letters and performing collection actions through any communication media and/or officers designated by Maybank.
      6. Macet (Bad Debt): There is a delay in payment of the principal and/or interest on the Credit Card bill for more than 180 (one hundred eighty) calendar days. In this case, Maybank will exercise its rights under these Terms and Conditions, including performing collection actions in any manner it deems appropriate, such as through officers designated by Maybank or third parties collaborating with Maybank.
    11. Priority of Payment by the Maybank Credit Cardholder: The order of priority for payments made by the Maybank Credit Cardholder is as follows:
      1. Payment of Administrative Fees and Penalties: Payments will first be allocated towards clearing the administrative fees and any penalties associated with the credit card.
      2. Payment of 60% of the Principal Transaction Amount: After settling fees and penalties, 60% of the payment will be applied to reducing the principal balance of the credit card transactions.
      3. Payment of 40% of the Interest Charges: The remaining payment will be used to cover 40% of the interest charges accumulated on the credit card balance. Minimum Payment, Interest, and Other Fees 

  10. Authorization
    1. For each transaction using the Credit Card, authorization is required before it is accepted by the Merchant. Maybank has the right to deny authorization for any transaction without giving any reason or prior notice, and Maybank shall not be held responsible to the Credit Cardholder or any other party for any consequences arising from such denial.
    2. When Maybank grants authorization, it considers the transaction as having been executed/occurred, and therefore, the available Credit Limit on the Credit Card will be reduced by the amount that has been approved.
    3. If the Merchant issues a bill related to a purchase/transaction, once the bill is received by Maybank, the amount indicated on the bill will be charged to the Credit Card.
    4. Blocking and/or Cancellation of Credit Card
    5. The Credit Cardholder understands that Maybank, as the creditor, has the right and authority to block and/or cancel the Credit Card, either temporarily or permanently.
    6. In the event of blocking and/or cancellation of the Credit Card, Maybank has the right to declare that the entire outstanding balance of the Credit Cardholder is due and payable immediately and must be settled in full.
    7. The blocking and/or cancellation of the Credit Card occurs if one or more of the following events take place:
    8. Maybank believes that the Credit Cardholder and/or guarantor (if any) has violated the terms in the Credit Card Usage Document, including any extensions/changes/updates as well as any other existing or future terms, including in the event of a Cross Default;
    9. The Credit Cardholder’s name is listed in the Bank Indonesia Blacklist and/or the Indonesian Credit Card Association (AKKI) Blacklist;
    10. The Credit Cardholder and/or guarantor (if any) fails to comply with a credit agreement or any other agreement made with Maybank;
    11. The Credit Cardholder fails to pay the Outstanding Balance or pays less than the minimum payment;
    12. The Credit Cardholder and/or guarantor (if any) is involved in a civil or criminal case;
    13. The assets of the Credit Cardholder and/or guarantor (if any) are seized;
      The Credit Cardholder and/or guarantor (if any) passes away, is incapacitated, declared legally incompetent, or is declared bankrupt/dissolved/liquidated, or their business license is revoked;
    14. The financial condition, creditworthiness, and solvency of the Credit Cardholder and/or guarantor (if any), in Maybank's view, deteriorate to the point that it affects the ability of the Credit Cardholder and/or guarantor (if any) to fulfill their obligations based on the Credit Card Usage Document;
    15. The documents, statements, or information provided by the Credit Cardholder and/or guarantor (if any) to Maybank are found to be false/incomplete or the Credit Cardholder fails to provide accurate and complete information as required by Maybank;
    16. A request from the Credit Cardholder or their authorized representative, or an order from the relevant authority as per applicable laws;
    17. Maybank is unable to contact the Credit Cardholder and/or guarantor (if any);
    18. Maybank believes that the Credit Cardholder is involved in fraudulent transactions;
    19. Maybank exercises its right to declare Cross Default
    20. The Credit Cardholder terminates the use of the Credit Card;
    21. Based on the Credit Cardholder's credit quality report, a decline in quality is reported by other banks according to applicable banking regulations.

  11. Blocking and/or Cancellation of Credit Card
    1. The Credit Cardholder understands that Maybank, as the creditor, has the right and authority to block and/or cancel the Credit Card, either temporarily or permanently.
    2. In the event of blocking and/or cancellation of the Credit Card, Maybank has the right to declare that the entire outstanding balance of the Credit Cardholder is due and payable immediately and must be settled in full.
    3. The blocking and/or cancellation of the Credit Card occurs if one or more of the following events take place:
      1. Maybank believes that the Credit Cardholder and/or guarantor (if any) has violated the terms in the Credit Card Usage Document, including any extensions/changes/updates as well as any other existing or future terms, including in the event of a Cross Default;
      2. The Credit Cardholder’s name is listed in the Bank Indonesia Blacklist and/or the Indonesian Credit Card Association (AKKI) Blacklist;
      3. The Credit Cardholder and/or guarantor (if any) fails to comply with a credit agreement or any other agreement made with Maybank;
      4. The Credit Cardholder fails to pay the Outstanding Balance or pays less than the minimum payment;
      5. The Credit Cardholder and/or guarantor (if any) is involved in a civil or criminal case;
      6. The assets of the Credit Cardholder and/or guarantor (if any) are seized;
        The Credit Cardholder and/or guarantor (if any) passes away, is incapacitated, declared legally incompetent, or is declared bankrupt/dissolved/liquidated, or their business license is revoked;
      7. The financial condition, creditworthiness, and solvency of the Credit Cardholder and/or guarantor (if any), in Maybank's view, deteriorate to the point that it affects the ability of the Credit Cardholder and/or guarantor (if any) to fulfill their obligations based on the Credit Card Usage Document;
      8. The documents, statements, or information provided by the Credit Cardholder and/or guarantor (if any) to Maybank are found to be false/incomplete or the Credit Cardholder fails to provide accurate and complete information as required by Maybank;
      9. A request from the Credit Cardholder or their authorized representative, or an order from the relevant authority as per applicable laws;
      10. Maybank is unable to contact the Credit Cardholder and/or guarantor (if any);
      11. Maybank believes that the Credit Cardholder is involved in fraudulent transactions;
      12. Maybank exercises its right to declare Cross Default
      13. The Credit Cardholder terminates the use of the Credit Card;
      14. Based on the Credit Cardholder's credit quality report, a decline in quality is reported by other banks according to applicable banking regulations.
    4. Maybank has the right to:
      1. Cancel without conditions the credit limit of the Credit Card that has not been withdrawn/used by the Credit Cardholder, with immediate notification to the Credit Cardholder after the cancellation takes effect; or
      2. Automatically cancel the credit limit of the Credit Card that has not been withdrawn/used by the Credit Cardholder if the quality of the assets declines to a less favorable, doubtful, or problematic status, with immediate notification to the Credit Cardholder after the cancellation takes effect.

  12. Objection to Specific Bills and Complaint Procedures
    1. If the Credit Cardholder objects/disagrees with the Charges listed in the Billing Statement and/or wishes to file a complaint regarding services or transactions related to the Credit Card, the Credit Cardholder must submit the objection or complaint in writing along with supporting documents, which include a copy of the Billing Statement, a copy of the identity card (KTP/Passport), the Sales Draft (if any), and a copy of the Credit Card. This must be done within 30 calendar days from the Billing Date and submitted to Maybank.
    2. Objections or complaints can be made by contacting Maybank Customer Care at 1500611 or +6221 78869811 (from overseas) or via email at customercare@maybank.co.id or through the Maybank Card Center at PO Box 2863 Jakarta 10001.
    3. Maybank will process and follow up on the Credit Cardholder's objections or complaints within 30 (thirty) Business Days from the date the supporting documents are complete, with the condition that Maybank reserves the right to extend the estimated resolution time based on the complexity of the issue and the need for investigations with related parties.
    4. Objections or complaints received by Maybank after the time period mentioned in clause XII.1 will not be processed further, and any losses mentioned in such objections or complaints will be the full responsibility of the Credit Cardholder.
    5. Unless stated otherwise by Maybank, while the objection or complaint is being processed, the Primary Credit Cardholder is required to pay their obligations/bills first.
    6. If the Credit Cardholder feels they are no longer able to pay or settle their Credit Card bills, the Credit Cardholder must contact Maybank and provide a written explanation along with supporting documents/evidence. If Maybank agrees, Maybank may consider credit restructuring.

  13. Damaged, Lost or Misused Credit Card
    1. If the Credit Card is damaged or cannot be used as intended, the Credit Cardholder must immediately notify Maybank.
    2. If the Credit Card is lost and/or misused, the Credit Cardholder must immediately report this to Maybank, followed by submitting the original Police Report of the Lost Credit Card (or report from the appropriate authority) and any documents required by Maybank, which will be communicated periodically.
    3. Even though the loss of the Credit Card has been reported to Maybank, the Credit Cardholder remains responsible for any unauthorized transactions arising from the loss, theft, or misuse of the Credit Card until the original Police Report of the Lost Credit Card is received and acknowledged by the authorized officers at Maybank.
    4. If Maybank considers there is an irregularity regarding the damage, loss, or misuse of the Credit Card, or if the Credit Cardholder has not settled their bill since the Due Date, or if there are any other reasons (which do not need to be disclosed to the Credit Cardholder), Maybank may refuse to issue a new/replacement Credit Card.
    5. If the lost Credit Card is later found, for security purposes or to prevent further misuse, the Credit Card must be returned to Maybank in a condition where it is cut into two parts, including cutting through the chip or magnetic stripe of the Credit Card.

  14. Confidentiality and Information to Third Parties
    1. The Credit Cardholder hereby grants Maybank the consent to exchange information about the Credit Cardholder’s data or identity with other parties, including other credit card issuers and/or the Indonesian Credit Card Association (AKKI), in accordance with the applicable regulations.
    2. The Credit Cardholder must maintain the confidentiality of the information such as CVV number (3 digits on the card), PIN, and OTP of the Credit Card and must not disclose this information to any other party (including the bank) through any means.
    3. Confidential Information refers to all data (including, but not limited to, Personal Data as defined in Law No. 27 of 2022 on Personal Data Protection and its amendments), reports, and/or other documents used in the implementation of these Terms and Conditions, including but not limited to matters that must be kept confidential by each party in accordance with the provisions of Law No. 10 of 1998 on the Amendment of Law No. 7 of 1992 on Banking, Financial Services Authority Regulation No. 22 of 2023 on Consumer and Public Protection in the Financial Services Sector, Law No. 4 of 2023 on the Development and Strengthening of the Financial Sector, Law No. 27 of 2022 on Personal Data Protection, including all its amendments, and internal Maybank regulations.
      1. If there is a change in Confidential Information, the Credit Cardholder must notify Maybank of the change in writing and/or orally, accompanied by supporting data/documents.
      2. If the data/information and/or documents provided by the Credit Cardholder are incorrect, Maybank has the right to impose sanctions.

    If the Credit Cardholder intends to provide Confidential Information owned by or from Maybank to any third party, prior written consent from Maybank must be obtained, unless specified otherwise by the relevant authority and/or binding regulations that must be complied with.

  15. Power of Attorney and Authority
    1. The Primary Maybank Credit Cardholder grants power of attorney and authority, with the right of substitution and irrevocability, to Maybank as the creditor, to exercise the rights and obligations arising from the Credit Card Usage Documents. This power includes the provision of information or data of the Maybank Credit Cardholder to third parties for the purposes of marketing Maybank products, promoting the benefits/use of the Credit Card, cross-selling, and other commercial purposes, provided that the Primary Maybank Credit Cardholder has given prior written consent.
    2. If, in the performance of Maybank’s rights and obligations, a separate Power of Attorney is required, or if a change in the law or the enactment of new legislation requires Maybank to obtain a separate specific power of attorney from the Primary Maybank Credit Cardholder, then the Primary Maybank Credit Cardholder is required to sign and provide such power of attorney at Maybank's first request.
    3. As long as the Primary Maybank Credit Cardholder still has obligations to Maybank, any power of attorney granted by the Credit Cardholder, including any power granted in the Credit Card Usage Documents, cannot be revoked/canceled without prior written consent from Maybank and will not terminate for any reason, including reasons set forth in Articles 1813, 1814, and 1816 of the Indonesian Civil Code.

  16. Notifications
    1. Every notification, including the Billing Notice as referred to in Article VIII.2, will be sent to the address of the Primary Maybank Credit Cardholder as recorded in Maybank's data.
    2. The Primary Maybank Credit Cardholder must immediately notify Maybank if there is a change in the billing address, residential address, or the address of the company where the Credit Cardholder works.
    3. The Primary Maybank Credit Cardholder agrees that written notifications, including the Billing Notice, sent by Maybank may be in the form of printed computer documents and/or other electronic document formats. The Primary Maybank Credit Cardholder agrees that such notifications are valid and binding notices and can be used as valid evidence both in and out of court.
    4. If the Primary Maybank Credit Cardholder wishes to ask questions, raise objections, or obtain information related to the Credit Card, they can contact the address, phone number, or email as stated on the Billing Notice or the contact details on the back of the Credit Card.
    5. Maybank is not responsible for delays in receiving the Billing Notice caused by the negligence of the Credit Cardholder.
    6. If the Billing Notice is delayed or not received by the Credit Cardholder, the Credit Cardholder is required to report it to Maybank.

  17. Extension, Termination of Credit Card Use, and Replacement of Credit Card
    1. The validity period of the Credit Card can be found on the Credit Card or in a notice that Maybank will provide from time to time.
    2. Unless otherwise stated by Maybank, the Credit Card may be automatically extended when its validity period expires.
    3. If Maybank agrees to extend the validity period of the Credit Card, Maybank will issue a new Credit Card at a cost that will be the responsibility of the Primary Maybank Credit Cardholder.
    4. If Maybank agrees, based on a request from the Primary Maybank Credit Cardholder, Maybank may issue a replacement Credit Card at a cost that will be the responsibility of the Primary Maybank Credit Cardholder.
    5. Maybank will approve the termination of the Credit Card use if all obligations have been settled or if the Credit Cardholder has paid off the outstanding balance.
    6. If Maybank intends to terminate its relationship/terminate the provision of Credit Card facilities to the Credit Cardholder, the Credit Cardholder must fulfill any unresolved obligations at the time of termination. If the Credit Cardholder has not settled the obligations with Maybank, the Credit Cardholder grants Maybank the authority to debit the Credit Card collateral (if any) and/or debit funds from the Credit Cardholder's savings/deposit/other accounts at Maybank.
    7. Maybank is not responsible if there is a failure to issue a new Credit Card as referred to in Article XVII.3 and Article XVII.4.

  18. Dispute Resolution and Legal Domicile
    1. This Credit Card Usage Document is subject to the laws of the Republic of Indonesia.
    2. If a dispute arises related to this Credit Card Usage Document, the Parties may conduct discussions to resolve the dispute or agree to settle it first through the Banking Mediation mechanism as regulated by Bank Indonesia.
    3. If the mechanism referred to in Article XVIII.2 above cannot resolve the dispute, the Parties agree to choose the legal domicile as valid and binding at the Court Clerk's Office of the Central Jakarta District Court, without prejudice to Maybank’s right to file a lawsuit/claim through other district courts within the Republic of Indonesia.

  19. Life Insurance for the Credit Card Holder to Settle Credit Card Obligations
    1. If the Credit Card Holder agrees, the Main Credit Card Holder may become a policyholder of the credit card life insurance for settling the obligations of the Credit Card.
    2. The life insurance referred to in Article XIX.1 is not a Maybank product, but a product from an insurance company selected by the Credit Card Holder.
    3. If the credit life insurance premium is paid using the Credit Card, the Main Credit Card Holder agrees that all costs related to the credit life insurance premium will be charged to the Main Credit Card Holder.
    4. The risks covered by the life insurance company are listed in the credit life insurance policy, where the beneficiary or the recipient of the insurance payout is Maybank.
    5. The money received from the insurance company will be used to settle part or all of the Credit Card Holder's outstanding bills/obligations.
    6. If Maybank does not receive the insurance payout or if the payout received by Maybank from the insurance company is insufficient to settle the Credit Card Holder's full bill, the Credit Card Holder and/or their heirs and/or the party assuming the Credit Card Holder’s obligations remain responsible for the remaining outstanding bills/obligations.
    7. The Credit Card Holder releases Maybank from any actions of the insurance company and fully understands that credit life insurance is not a product of Maybank. The Main Credit Card Holder also releases Maybank from any responsibility regarding the insurance claims.

  20. Acknowledgment and Proof of Debt
    1. The Credit Card Holder hereby acknowledges and affirms, immediately upon the obligation of annual fees and when the Credit Card is used, that they are legally indebted to Maybank, including the interest, penalty interest, fees, and other amounts that the Credit Card Holder is required to pay to Maybank based on these Terms and Conditions.
    2. The Credit Card Holder agrees that the amount owed under these Terms and Conditions will be proven by documents such as books, records, and administrative files maintained by Maybank regarding or related to the annual fees and/or the use of the Credit Card.

  21. Declaration
    1. The Credit Card Holder promises to fulfill all obligations and comply with all of these Terms and Conditions in good faith.
    2. The Credit Card Holder has (i) understood the explanation provided by Maybank regarding these Terms and Conditions, (ii) been given sufficient time to understand and review these Terms and Conditions, (iii) understood/aware of the benefits, costs, risks, rights, and obligations that the Credit Card Holder will bear in relation to the implementation of these Terms and Conditions, (iv) understood the characteristics of the Credit Card and declares that the Credit Card product received from Maybank suits the needs of the Credit Card Holder.
    3. The Credit Card Holder has submitted guarantees and documents related to these Terms and Conditions and has obtained the necessary approvals from the relevant parties that require the Credit Card Holder to obtain such approvals in order to establish these Terms and Conditions and/or to create and sign the documents required by Maybank.

  22. Personal Data Protection
    1. All data, information, and/or documents provided by the Credit Card Holder to Maybank for the purpose of providing/providing the Credit Card facility ("Purpose") are true, accurate, and up to date as per the original (if provided in the form of a copy). If there are changes to the data and/or documents, the Credit Card Holder is required to notify Maybank of these changes in writing and/or orally along with supporting documents. If the data/information and/or documents submitted by the Credit Card Holder are incorrect, Maybank shall not be responsible for any consequences arising from the provision of such data/information and/or documents.
    2. The Credit Card Holder agrees and authorizes Maybank to use, manage, disclose, or conduct verification checks with third parties working with or appointed by the Bank, regarding all data, information, and documents received by the Bank regarding the Credit Card Holder, including but not limited to personal data, transactions, status, and collectability.
    3. If there is data, information, and/or documents belonging to another party provided or submitted by the Credit Card Holder to Maybank, the Credit Card Holder declares and guarantees that they have obtained lawful consent from the other party to provide such data, information, and/or documents to Maybank for use during the period necessary in relation to the Purpose, and Maybank will store the data, information, and/or documents belonging to the other party in accordance with the data security standards applicable to Maybank.
    4. The Credit Card Holder understands that Maybank processes Personal Data and applies the principles of Personal Data protection in accordance with the provisions of Law No. 27 of 2022 concerning the Protection of Personal Data, including amendments from time to time (hereinafter referred to as the PDP Law), and its implementing regulations, including the Financial Services Authority Regulation issued later. The Credit Card Holder can read the summary of Maybank's Personal Data processing policy in Maybank's Privacy Notice, which can be accessed at any time on the Maybank website: https://www.maybank.co.id on the Security and Privacy page. Maybank will update the Privacy Notice from time to time in accordance with Maybank's policies and/or to comply with Maybank's obligations under applicable laws and regulations. By agreeing to these Terms and Conditions, the Credit Card Holder acknowledges that they have read and understood Maybank's explanation regarding Personal Data processing and agrees to the definition of Personal Data used in these Terms and Conditions as defined in the PDP Law and gives consent to the Bank to process Personal Data by Maybank in connection with the Purpose.
    5. If, in the future, for any reason, Maybank provides personal data from the authorized representative of Maybank to the Credit Card Holder, the Credit Card Holder agrees and understands that they will apply the principles of Personal Data protection in accordance with the PDP Law. The Credit Card Holder agrees to take responsibility if the Personal Data received from Maybank is provided to other parties.

  23. Fraud Indications
    1. Maybank, including its directors/employees or any other party representing Maybank, is prohibited from requesting and/or receiving any money and/or gifts or anything in any form from the Credit Card Holder beyond what is agreed upon in the terms and conditions.
    2. Any act of requesting and/or receiving money and/or gifts or anything in any form from the Credit Card Holder beyond what is agreed upon in these Terms and Conditions is considered deviation or fraud or a violation of Maybank's provisions.
    3. The Credit Card Holder is prohibited from giving any money and/or gifts or anything in any form beyond what is agreed upon in these Terms and Conditions to the directors/employees or any other party representing Maybank.
    4. If the Credit Card Holder becomes aware of any indication/incident of deviation, fraud, or violation committed by the bank’s directors/employees or any other party representing Maybank, or if they are asked to give anything beyond what is agreed upon in the terms and conditions to the directors/employees of Maybank or any other party representing Maybank, the Credit Card Holder is required to report it to Maybank's whistleblower hotline via email at whistleblowing@maybank.co.id or via WhatsApp/SMS at 0811 1930 1000 or toll-free phone number 0800 1503034.
    5. In relation to point 4 above, Maybank will ensure the confidentiality of all information/data provided by the Credit Card Holder as the whistleblower, including the identity of the Credit Card Holder.

  24. Others
    1. The holder of the Supplementary Maybank Credit Card automatically binds themselves to these Terms and Conditions.
    2. These Terms and Conditions are applicable and binding on both Maybank and the Credit Card Holder, as well as their successors and/or assignees and/or recipients of their rights. Maybank, as the creditor, has the right to sell, assign, pledge, or transfer the receivables/debts from the Credit Card Holder to another Maybank branch, subsidiary, the Financial Services Authority/Bank Indonesia, or to any third party with whom Maybank enters into subrogation, assignment, joint financing, or any other cooperation agreement, with notice to the Credit Card Holder in accordance with applicable legal provisions.
    3. The Credit Card Holder may not transfer all and/or part of the Outstanding Balance on the Credit Card, including transferring any of their rights and/or obligations to any party without written consent from Maybank.
    4. The Credit Card Holder declares that they will not use the Credit Card for transactions that are prohibited by applicable laws and regulations.
    5. All transaction evidence or records maintained by Maybank are deemed valid and binding on the Credit Card Holder, unless proven otherwise by the Credit Card Holder.
    6. The Credit Card Holder agrees to treat all recordings/copies/microfilm documents made by Maybank as valid evidence, with the same legal effect as the original.
    7. In the event of a dispute between the Credit Card Holder and a merchant, the Credit Card Holder cannot refuse to fulfill their obligations as stated in the billing notice.
    8. The Credit Card Holder must comply with all applicable laws and regulations regarding foreign exchange transaction supervision and taxation concerning the use of the Credit Card. In this regard, the Credit Card Holder agrees to indemnify Maybank for any consequences arising from their failure to comply with these regulations.
    9. The Credit Card Holder agrees to provide Maybank with any necessary information, documentation, or records related to the use of the Credit Card as required by Maybank from time to time.
    10. The Credit Card Holder agrees to cooperate with Maybank in resolving any legal processes.
    11. The Credit Card Holder agrees and understands that Maybank has the right and authority to seek compensation from the Credit Card Holder and/or report the Credit Card Holder to law enforcement authorities if, in Maybank’s judgment, the Credit Card Holder engages in actions categorized as fraud, including cyber-attacks (whether the attempt is successful or not).
    12. To enhance transaction security and minimize misuse, the Credit Card Holder gives consent to Maybank to document transactions made with the Credit Card. This documentation may include, but is not limited to, photographs, recordings, and minutes. If necessary, the Credit Card Holder agrees and authorizes Maybank to store this documentation. The Credit Card Holder agrees to use/display this documentation to third parties in a reasonable manner for the purpose of proving or securing Credit Card transactions.
    13. By conducting transactions using the Credit Card, the Credit Card Holder agrees to be bound by all terms and conditions in these Terms and Conditions. The Credit Card Holder will comply with applicable laws and regulations, including those of the Financial Services Authority.
    14. Failure, delay, or postponement by Maybank in exercising its rights under the Credit Card Usage Document, or failure, delay, or postponement by Maybank in requesting the Credit Card Holder to fulfill the provisions in the Credit Card Usage Document, will not be considered as a waiver or relinquishment of rights, authority, or claims by Maybank to later enforce the provisions of the Credit Card Usage Document.
    15. Any termination of the provisions and requirements in the Credit Card Usage Document overrides Article 1266 of the Civil Code.
    16. The Credit Card Holder declares and guarantees that they, their subsidiaries, officers, directors, supervisors, managers, agents, or employees will comply with the provisions of these Terms and Conditions in accordance with applicable laws, including but not limited to laws related to the prevention and eradication of money laundering and terrorist financing in Indonesia. Maybank has the right to take actions it deems necessary to protect its interests, including terminating the Credit Card facility if the Credit Card Holder is identified as engaging in money laundering and/or terrorist financing activities.
    17. These Terms and Conditions have been adjusted to comply with applicable laws, including the provisions of the Financial Services Authority regulations.

Maybank employees are prohibited from asking for/receiving/giving rewards.
