Benefits, Fees, and Product Risks

Benefits, fees, and product risks of Pegadaian Gold Savings and the service of Gold Savings transactions on M2U ID App (mobile banking) refers to Summary of Product & Service Information Detail of Pegadaian Gold Savings (“RIPLAY”).

Definition

The terms stated below have definitions and meanings as follows, unless the context dictates the otherwise:

  1. Pegadaian Gold Savings Passbook hereinafter referred to as Gold Savings Passbook is a customer’s prove of ownership for the gold stored at Pegadaian that contains of transaction records from Gold Savings account number.
  2. Calendar Day, is every Monday to Sunday in the AD Year, including public holidays according to Government of Indonesia. 
  3. Working Day, is the day where the Bank conducts clearing transactions nationwide.
  4. Public Holiday, is the public holidays according to the Government of Indonesia. 
  5. Purchase Price per Gram, is the purchase price per gram of Gold Savings based on the gold price that will be updated every calendar day after 02.00 WIB. The purchase price of Gold Savings will be updated regularly outside of that time based on the most recent information from Gallery 24 via Pegadaian.
  6. Selling Price per Gram, is the selling price per gram of Gold Savings based on the gold price that will be updated every calendar day after 02.00 WIB. The selling price of Gold Savings will be updated regularly outside of that time based on the most recent information from Gallery 24 via Pegadaian.
  7. Gold Holding is the amount of gram/value of Gold Savings owned by the Customer. 
  8. Know Your Customer (“KYC”) is the principle applied by the Financial Services Provider in order to acknowledge the background and the identity of the Customer; monitoring Securities accounts and Customer transactions; as well as reporting Suspicious Financial Transactions and financial transactions conducted in cash in accordance with laws and regulations in the field of Capital Markets as well as laws and regulations related to the prevention and eradication of money laundering crimes and/or prevention and eradication of terrorism financing crimes.
  9. M2U ID App (mobile banking) is a mobile banking application provided by Maybank Indonesia which can be used to make Gold Savings transaction.
  10. Customer is the person/Bank’s Customer that makes Gold Savings transactions on M2U ID App (mobile banking). To avoid hesitation, the terms of “I”,”You”, and/or “Account Holder”, refers to Customer as a person/investor that makes every transaction of Pegadaian Gold Savings Product. 
  11. ID Number (“NIK”) is a resident identity number that is unique or distinctive, single and attached to a person who is registered as a resident of Indonesia.
  12. Pegadaian Gold Account Number is a unique number owned by every customer who has a Pegadaian account/Gold Savings Account issued by Pegadaian.
  13. Gold Savings Purchase is an electronic Gold Savings purchase transaction on M2U ID App (mobile banking).
  14. Gold Savings Sell is an electronic transaction of selling Gold Savings on M2U ID App (mobile banking).
  15. PT Pegadaian Galeri Dua Empat (“Galeri 24”) is a subsidiary of Pegadaian engaged in gold trading.
  16. Pegadaian Gold Savings Account is a financial account for recording financial transactions between the Customer and Pegadaian for product transactions provided by the Pegadaian.
  17. Gold Savings Transaction History is a record of all transactions consisting the amount of gold owned by the Customer on M2U ID App (mobile banking) which can be accessed by the Customer through Pegadaian Gold Savings feature on M2U ID App (mobile banking).
  18. Holding Balance is the minimum value/amount of Gold Savings that must be left or stored in Gold Savings which cannot be sold by the Customer.
  19. Gold Savings Balance is the value and amount of the Customer's Gold Savings deposited in with Pegadaian which is recorded in the Gold Savings Account.
  20. The Terms and Conditions of Pegadaian Gold Savings are terms and conditions regarding Gold Savings issued and owned by Pegadaian. The terms and conditions of Pegadaian's Gold Savings can be accessed by the Customer on M2U ID App (mobile banking).
  21. Gold Savings is gold owned by the customer that was gained from using the Pegadaian Gold Savings feature on M2U ID App (mobile banking). The physical gold is stored by the Pegadaian. 

 

Registration and Opening Account of Pegadaian Gold Savings on M2U ID App (mobile banking)

Before the customer is able to make Pegadaian Gold Savings transactions on M2U ID App (mobile banking), the customer must fulfill these followings requirements and comply to the terms and conditions below: 

  1. Must have Savings Account in Maybank that can be used to make transactions on M2U ID App (mobile banking) 
  2. Must have conducted the KYC for the account opening process of Pegadaian Gold Savings that is required by the Pegadaian. 
  3. Must have an identity card (KTP) and selfie photo registered in the bank system.
  4. Conduct registration and account opening of Pegadaian Gold Savings on M2U ID App (mobile banking). If the customer already has an existing Pegadaian account, the customer will still have to register and open a new account on M2U ID App (mobile banking). Therefore the customer will have a different account number from the previous account. The account number that will be used to make Pegadaian Gold Savings transactions is the one that is registered through M2U ID App (mobile banking). In that case, the customer is required to fill in additional information. Customer data recorded in the bank system and additional information will be shared to Pegadaian in the use of Pegadaian Gold Savings registration and transaction. 
  5. The customer data that will be shared to Pegadaian (“Data Related to KYC of Pegadaian Gold Savings”) stated below: 
    • Customer Name is in accordance with the identity card (Kartu Tanda Penduduk/KTP)
    • Identity Number (NIK)
    • Phone/Cell Number
    • ID Card Photo
    • Selfie Photo
    • Nationality
    • Birth Place and Birth Date
    • Sex
    • Religion
    • Mother’s Maiden Name
    • Domicile Address
    • Marital Status
    • Occupation
    • Average Income
    • Source of Fund/Income
    • Education
    • Outlet Pegadaian Option
    • Address on ID Card (RT/RW, Ward, Sub-District, Region, Province)
    • Recent Occupation (if different on ID Card)
    The data submission related to KYC of Pegadaian Gold Savings Account has a purpose to fulfil the KYC process and the registration of account opening in Pegadaian. Customer gives consents to the Bank to share their data related to KYC of Pegadaian Gold Savings account to Pegadaian. 

    Data related to KYC of Pegadaian Gold Savings Account that has been received by the Pegadaian will be further processed by the Pegadaian and if it meets the requirements, the Customer can open/have a Pegadaian Gold Savings Account. The Customer understands that Pegadaian has the authority to process or perform certain actions related to Data Related to KYC of the Pegadaian Gold Savings Account including offering Pegadaian products and services.

Gold Savings Purchase on M2U ID App (mobile banking) 

  1. The first Gold Savings Purchase transaction on M2U ID App (mobile banking) is conducted together with the registration of the Pegadaian Gold Savings through the M2U ID App (mobile banking) with the following conditions:
    • The first purchase of Gold Savings is IDR10,000 (ten thousand Rupiahs) or if in gram  shall be equivalent to IDR10,000 (ten thousand Rupiahs).
    • The maximum purchase of Gold Savings that can be made for the first time purchase is equivalent to the value of 10 (ten) grams of Pegadaian gold.
  2. The minimum purchase of Gold Savings on M2U ID App (mobile banking) is IDR10,000 (ten thousand Rupiahs) or if in gram shall be equivalent to IDR10,000.00 (ten thousand Rupiahs).
  3. For customers who make second purchase and so on, the maximum Purchase of Gold Savings that can be made through M2U ID App (mobile banking) in one transaction is IDR 50,000,000.00 (fifty million Rupiahs) or in 1 (one) day is the equivalent of 100 grams of Pegadaian gold. 
  4. The purchase price per gram will be updated by the Pegadaian with a maximum update up to 3 (three) times in 1 (one) day after 02.00 WIB. Price changes may occur on a regular basis outside of this time due to fluctuations in global prices where the updated information will be made by Galeri 24 through Pegadaian.
  5. The price for Gold Savings displayed on M2U ID App (mobile banking) chart follows the gold market price movement based on the data provided by Pegadaian.
  6. The purchase price per gram displayed on M2U ID App (mobile banking) is the price that applies at the time when a customer makes a purchase transaction.
  7. There is no transaction fee to purchase Gold Savings on M2U ID App (mobile banking).
  8. If gold price changes occur when the customer is conducting payment on M2U ID App (mobile banking), the gold purchase transaction will be rejected and will fail. The Customer will receive a notification informing that the transaction failed. If transaction failed, the customer can try again to purchase Gold Savings transaction. 
  9. Gold Savings transaction can only be conducted at 04:00 – 19:59 Western Indonesian Time.
  10. If gold purchase transaction is conducted outside the operational hour as stated above in poin 9, M2U ID App (mobile banking) will display an error message and the transaction will not be proceeded.
  11. Customer can only choose Savings account (cannot Current account) when making Pegadaian Gold Savings purchase.
  12. To complete the purchase of Gold Savings on M2U ID App (mobile banking), customers will be required to request SMS TAC (Transaction Authentication Code) or input Secure2U or any other ways stated on M2U ID App (mobile banking).

Gold Savings Selling Transaction on M2U ID App (mobile banking) 

  1. The minimum sell of Gold Savings that can be conducted on M2U ID App (mobile banking) is 0.01 gram.
  2. The maximum sell of Gold Savings that can be conducted on M2U ID App (mobile banking) in one transaction is 20 (twenty) grams. The maximum sell of Gold Savings that can be conducted on M2U ID App (mobile banking) per customer per day is 100 (one hundred) grams.
  3. Selling price per gram will be updated by the Pegadaian a with maximum update up to 3 (three) times in 1 (one) day after 02.00 WIB. Price changes may occur on a regular basis outside of this time due to fluctuations in global prices where the updated information will be made by Galeri 24 through Pegadaian.
  4. The purchase price per gram displayed on M2U ID App (mobile banking) is the price that applies at the time when a customer makes a selling transaction.
  5. There is no transaction fee to sell Gold Savings balance on M2U ID App (mobile banking).
  6. The customer can only sell their Gold Savings balance after the amount of Gold Savings owned by customer has been deducted by the minimum Holding Balance. 
  7. Before selling Gold Savings balance, the customer must have the minimum holding balance refers to Summary of Product & Service Information Detail of Pegadaian Gold Savings (“RIPLAY”).
  8. The customer that does not fulfil the minimum holding balance referred in the RIPLAY and The Terms and Conditions of Pegadaian Gold Savings will not be able to make any Gold Savings selling transaction. 
  9. If gold price changes occur when Customer is selling gold on M2U ID App (mobile banking), the gold selling transaction will be rejected and will be notified as failed. The Customer will receive a notification informing that the transaction is failed. If transaction is failed, the customer can try to sell the gold again. 
  10. Gold Savings transaction can only be conducted at 04:00 – 19:59 Western Indonesian Time.
  11. If gold selling transaction is conducted outside the operational hour as stated above in poin 10, M2U ID App (mobile banking) will display an error message and the transaction will not be proceeded.
  12. Customer can only choose Savings account (cannot choose Current account) when selling gold balance of Pegadaian Gold Savings. 
  13. To complete the gold selling transaction on M2U ID App (mobile banking), the customer will be required to request SMS TAC (Transaction Authentication Code) or input Secure2U or any other ways stated on M2U ID App (mobile banking).

Customer Statements and Guarantees

Hereby the Customer states and guarantees to the Bank that: 

  1. The Customer is the legal owner of the funds used to make Gold Savings transactions. Funds are not obtained from a criminal act including money laundering/terrorism financing and so on which are the result of a criminal act. The Customer will not use the Pegadaian Gold Savings as a tool/means for a crime including but not limited to money laundering.
  2. By making Gold Savings transactions through M2U ID App (mobile banking), the Customer is consciously fully responsible for all actions taken. The risk of the Customer’s Gold Savings transaction is entirely the responsibility of the Customer. The Customer releases the Bank, including its subsidiaries, affiliates, shareholders, directors, officers, employees in full from all claims, losses, payments or any costs incurred, suffered by the Customer or submitted to the bank directly or indirectly, including among others legal advisor fees and case costs, as long as it is proven that it was not caused by the fault of the Bank.
  3. The Customer understands that the Bank is not responsible for losses that occur and does not guarantee the profit that will be obtained by the customer from buying and selling Gold Savings transactions carried out on the M2U ID App (mobile banking).
  4. The Customer agrees that the Bank has the right to change these Terms and Conditions by giving notification to the Customer 30 (thirty) days before the changes to these Terms and Conditions take effect. 
  5. The Customer agrees that the Bank at its own discretion may reject the Customer's instructions if the Customer does not follow the provisions applied at the Bank. If rejection occurs, the Bank is not obliged to pay any losses to the Customer. 
  6. The Customer must notify the Bank written notification if there is any changes to the identity and/or data of the customer. The Customer's negligence in doing so is entirely the responsibility and risk of the Customer.
  7. Any data, information, instructions that have been or will be listed for the purposes of Gold Savings transactions and other documents provided by the Customer to the Bank are correct, valid and up-to-date. The Customer is responsible for and releases the Bank from all claims and compensation from both the Customer and other third parties if it is later discovered that the data provided by the Customer is incorrect or false. 

Power of Authority 

  1. The Customer gives power and authority with the right of substitution to the Bank :  
    • Deducting funds from the Customer's account at the bank to complete and conduct Gold Savings transaction through M2U ID App (mobile banking) according to the Customer's instructions.
    • Administer and store all Gold Savings transaction evidence on M2U ID App (mobile banking).
  2. As long as the customers still have obligations to the Bank, the powers granted by the Customer to the Bank as stated in these Terms and Conditions cannot be revoked or will not expire for any reason, including but not limited to the reasons for the expiration of the said power of attorney. See in articles 1813, 1814 and 1816 of the Civil Code.
  3. All power and authority granted by the customer to the Bank is the part that cannot be separated from these Terms and Conditions.
  4. If during the implementation of these Terms and Conditions there is a change in provisions or there is a new statutory provision requiring the Bank to obtain a separate special power of attorney from the customer to exercise the rights of the Bank, the customer must sign and provide the power of attorney to the Bank at the first request from the Bank.

Complaints

  1. The customer can file complaint reports related to the use of the M2U ID App (mobile banking) to Maybank Customer Care. For information of products or 24 hr service, customer can contact Maybank Customer Care at 1500611 or +622178869811 (from overseas) or via email to customercare@maybank.co.id  (Monday - Friday at 08:00 – 20:00 Western Indonesia Time and Saturday - Sunday at 08:00 – 17:00 Western Indonesia Time).

  2. In filing complaint reports to the Bank, the Customer is required to fill out a Complaint Form. The time for settlement of these complaints will refer to the following corporate website: Click here.

Law Applied and Jurisdiction

The applied law, jurisdiction and procedures for settling disputes between the Bank and the Customer regarding the Gold Savings transaction through M2U ID App (mobile banking) as stated in these Terms and Conditions will follow the provisions that apply to the Terms and Conditions for Deposit Accounts issued by the Bank.

Others

  1. For any customer information and data received by the Bank, the Bank can store, use, share to Pegadaian and/or publish such information and data based on the customer's approval or as long as its aim is to complete the Gold Savings transaction through M2U ID App (mobile banking) and complies with the applied laws and regulations. 
  2. Hereby the customer has received a complete explanation from the Bank regarding the actions of obtaining, collecting, processing, analyzing, storing, displaying, announcing, sending and disseminating as well as the confidentiality or non-confidentiality of personal data. 
  3. The gold purchase and sell prices that displayed on M2U ID App (mobile banking), which provided by Pegadaian are the same as the purchase and sell prices of gold in other platforms that partnered with Pegadaian.
  4. The Gold Savings transactions will only be executed after the payments are verified on M2U ID App (mobile banking).
  5. The customer has no rights to cancel or change a Gold Savings transaction that has been declared successful on the M2U ID App (mobile banking).  
  6. The Customer must read carefully and check on these Terms and Conditions from time to time to acknowledge if there are any changes. By opening Pegadaian Gold Savings through M2U ID App (mobile banking), the Customer is considered to have read and agreed to these Terms and Conditions. 
  7. These Terms and Conditions are part of the Maybank2U ID Terms and Conditions that applied at the Bank.
  8. These Terms and Conditions have been adjusted to the provisions of the laws and regulations including the provisions of the Financial Services Authority (OJK) Regulations and the Customer declares that the Customer obeys the laws and regulations including the provisions of the applicable Financial Services Authority (OJK) Regulations.
