1. IMPORTANT NOTICE
    1. The Maybank Marathon Terms and Conditions (“Terms and Conditions”) and other regulations related to the Maybank Marathon (“MM”) are established to ensure that PT Bank Maybank Indonesia Tbk (“Organizer”) has planned and organized MM in accordance with the regulations stipulated by the Indonesian Athletics Association (Persatuan Atletik Nasional Indonesia/PASI) and World Athletics.
    2. Any person who has registered to participate in the MM running race but has not yet been confirmed by the Organizer as an eligible participant in the MM running race shall be referred to as a prospective runner (“Prospective Runner”), while a registrant who has registered to participate in the MM running race and has been confirmed by the Organizer as an eligible participant in the MM running race shall be referred to as a runner (“Runner”).
    3. Each MM Prospective Runner is required to carefully read and understand the Terms and Conditions and the regulations related to MM prior to completing MM registration.
    4. By registering as an MM Runner, the Prospective Runner is deemed to have understood and agreed to the Terms and Conditions and other regulations related to MM.
    5. The Organizer reserves the right to request the Prospective Runner to submit the results of a medical examination regarding the his/her health condition, if deemed necessary by the Organizer.
    6. The Prospective Runner is required to ensure that he/she is in good health and physically capable of running in accordance with the category selected by the Prospective Runner within the time limit determined by the Organizer. The Prospective Runner understands that the Prospective Runner is responsible for his/her own health condition throughout the MM event.
    7. All registration fees that have been paid by the Runner to the Organizer are non-refundable.
    8. At the time of MM registration through the Public Drawing, the Prospective Runner shall be charged a fee of IDR10,000, which shall be debited from the credit card/financing card registered by the Prospective Runner. Such fee shall be refunded by the Organizer by crediting it back to the Prospective Runner’s credit card/financing card and shall subsequently be credited by the credit card/financing card issuing bank in accordance with the issuing bank’s policies.
    9. If the Prospective Runner is selected through the Public Drawing, the Prospective Runner’s credit card/financing card shall be debited on the Public Drawing announcement date for the registration fee as informed at the time of MM registration. The Prospective Runner is required to ensure that the credit card/financing card is active, not blocked, has no outstanding payment arrears, and does not exceed the applicable credit/financing limit.
  2. PUBLIC REGISTRATION
    1. The Prospective Runner shall register for MM through the official MM website at: https://www.maybankmarathon.com (“Website”). Upon successful completion of the MM registration process on the Website, each Prospective Runner shall receive an official registration acknowledgment issued by the Organizer and delivered to the Prospective Runner via the registered email address and/or WhatsApp number as proof of a valid registration transaction.
    2. The Prospective Runner is required to complete his/her personal information (“Personal Data”) truthfully, completely, and accurately. In the event of any change to or error in the submitted Personal Data, the Prospective Runner or Runner is required to notify the Organizer in writing via email at info@maybankmarathon.com, accompanied by the relevant supporting data and/or documents.
    3. Provisions regarding changes to Personal Data shall not apply to the substitution or replacement of a Prospective Runner’s or Runner’s Personal Data with the personal data of another individual, but shall only apply to changes to the Prospective Runner’s or Runner’s Personal Data arising from changes in civil status, data entry errors, and/or other lawful and justifiable changes.
    4. If any data, information, and/or documents submitted by the Runner are inaccurate, the Organizer shall not be responsible or liable for any consequences arising from such inaccuracy of the data, information, and/or documents.
    5. The Organizer reserves the right to take actions, including but not limited to, rejecting a Prospective Runner’s registration, cancelling a Runner’s participation, nullifying race results, cancelling the awarding of prizes received by the Runner, and/or imposing a prohibition on the Runner’s participation in MM events in subsequent years, if the Prospective Runner or Runner submits incorrect data, information, and/or documents to the Organizer or fails to comply with the terms and requirements determined by the Organizer.
    6. If the Prospective Runner does not receive the MM registration acknowledgment within five (5) calendar days after completing MM registration, the Prospective Runner may contact the Organizer via email at info@maybankmarathon.com.
    7. The Organizer has full authority to determine which Prospective Runners are accepted as MM Runners and are eligible to participate in the MM running race. All Prospective Runners who are accepted as MM Runners shall receive a participation confirmation email from the Organizer sent to the email address registered by the Prospective Runner (“MM Participation Confirmation”).
    8. The Organizer applies the principle of “You Register, You Run”, under which only individuals whose names are officially registered with the Organizer are entitled to participate in the MM running race. Any individual whose name is not registered shall not be entitled to run in MM.
    9. The collection of the running shirt, running BIB (including the bib number and the official timing chip), and the race pack (“Race Pack”) is mandatory and may only be carried out by the Runner in person at the location and within the time determined by the Organizer, upon presentation of the MM Participation Confirmation email and the Runner’s valid identification card. Race Pack collection may not be represented or delegated to any other party. A Runner who fails to collect the Race Pack and does not possess a running BIB shall not be permitted to participate in the MM event, including the running race.
  3. TERMS AND CONDITIONS OF MM EVENT
    1. Runners in the Marathon category must be at least eighteen (18) years of age. Runners in the Half Marathon category must be at least seventeen (17) years of age. Runners in the 10K category must be at least fifteen (15) years of age. A Runner’s age shall be determined based on the Runner’s age on the date of the MM event. The Organizer reserves the right to verify the Runner’s age by reference to the Runner’s valid official identification (KTP/ Passport/ KITAS/ KIA/ or other forms of identification approved by the Organizer) before, during, and/or after the MM event. Any exception to this provision may only be granted with the approval of the Organizer.
    2. Prospective Runners or Runners aged between fifteen (15) years and eighteen (18) years are required to submit a Parental or Legal Guardian Consent Letter, duly completed and signed by the parent or legal guardian of the Prospective Runner or Runner, together with a copy of a valid official identification of the parent or legal guardian (“Parental or Legal Guardian Consent Documents”), in the form of a clear and legible scanned copy or photograph. The format of the Parental or Legal Guardian Consent Letter may be accessed and downloaded through the Website or through other systems determined by the Organizer. The Prospective Runner or Runner is required to submit the Parental or Legal Guardian Consent Documents in accordance with the mechanism determined by the Organizer, either through the upload system on the Website and/or by submission to the Organizer’s official email address.
    3. In the event that a Prospective Runner or Runner aged between fifteen (15) years and eighteen (18) years fails to submit the Parental or Legal Guardian Consent Documents within the deadline informed and determined by the Organizer, the Organizer reserves the right to cancel the Prospective Runner’s registration or revoke the Runner’s participation status. The Organizer shall not refund any registration fees that have been received and shall not be responsible or have any obligation whatsoever in connection with such cancellation.
    4. Registration shall be processed after the registration fee has been fully paid and the registration process is confirmed as successful on the Website.
    5. The transfer and/or sale of MM participation is not permitted. The Organizer reserves the right to cancel a Runner’s participation status if any indication of transfer and/or sale of MM participation is identified.
    6. The Organizer reserves the right to limit and reject a Prospective Runner’s registration for any reason whatsoever, including but not limited to circumstances where the Prospective Runner has previously committed violations in other running competitions apart from MM.
    7. The Organizer reserves the right to contact and interview the Runner by telephone or other means in order to obtain data or information required in connection with MM registration. In this regard, Prospective Runners are advised to exercise caution when providing data or information by first verifying such requests with the Organizer. Information regarding the Organizer is available on the Website.
    8. The Organizer reserves the right to cancel the MM event in the event of circumstances beyond the Organizer’s control, including but not limited to extraordinary natural events, heavy rain, lightning, epidemics, civil unrest, or any other conditions which, in the Organizer’s assessment, may pose a potential risk to the safety of the Runners.
    9. If the MM event is cancelled due to circumstances beyond the Organizer’s control as referred to in point h above, the Organizer shall not be obliged to refund any registration fees that have been received and/or be responsible or liable for such cancellation of the MM event.
    10. The Runner is required to ensure that the Runner’s health condition is in good and fit condition to participate in the MM event. The Runner is responsible for his/her own health condition and, by participating in the MM event, is deemed to have understood the risks associated with the MM event. The Runner understands that the Organizer shall not be responsible or liable for any risk of injury, harm, or death arising during or after the MM event experienced by the Runner, except where such injury, harm, or death is proven to have resulted from the Organizer’s intentional negligence.
    11. The Organizer reserves the right to disqualify any Runner who is known or suspected to be in an unfit or unhealthy physical condition to participate in the MM event. If a Runner sustains an injury, harm, or other health-related issues during the MM event, then based on the recommendation of medical personnel appointed by the Organizer, such Runner may be treated at a hospital designated by the Organizer, with medical expenses determined by the Organizer.
    12. The Organizer reserves the right to disqualify a Runner and/or nullify the Runner’s race results if, based on the Organizer’s assessment, the Runner commits a violation or fails to comply with the rules and regulations of World Athletics, PASI, or the MM Terms and Conditions. In the event of such disqualification and nullification of race results, the Organizer shall not be obliged to refund any registration fees that have been received.
  4. PERSONAL DATA PROTECTION
    1. All data, information, and/or documents provided by the Runner to the Organizer for the purpose of participating in MM or required by the Organizer for the implementation of the MM event, enhancing the Runner’s experience in the MM event, and communicating with the Runner (“Purpose”) are true, accurate, and constitute the most current data and documents, and, where provided in copy form, are consistent with the originals.
    2. The Runner agrees and grants authorization to the Organizer to use, manage, disclose, and/or conduct examination or verification of information with third parties cooperating with or appointed by the Organizer, in respect of all data, statements, information, and documents received by the Organizer concerning the Runner, including but not limited to Personal Data.
    3. In the event that any data, information, and/or documents belonging to another party are provided or submitted by the Runner to the Organizer, the Runner represents and warrants that he/she has lawfully obtained valid consent from such other party to provide such data, information, and/or documents to the Organizer for use for the period necessary in connection with the implementation of the Purpose. The Organizer shall store such third-party data, information, and/or documents in accordance with the data security standards applicable to the Organizer.
    4. The Runner understands that the Organizer processes Personal Data and applies Personal Data Protection principles in accordance with the provisions of Law No. 27 of 2022 on Personal Data Protection, including any amendments thereto from time to time (“PDP Law”), its implementing regulations, and any other regulations that may be issued by the relevant authorities in the future.
    5. The Runner may review a summary of the Organizer’s Personal Data processing policy in the Privacy Notice, which is accessible at any time on the Website. The Organizer reserves the right to update the Privacy Notice from time to time in accordance with the Organizer’s policies and/or to comply with applicable laws and regulations. The Runner declares that he/she has read and understood the Organizer’s explanation regarding Personal Data processing, agrees that the definition of Personal Data used in this registration refers to the definition as stipulated under the PDP Law, and provides consent to the Organizer to process Personal Data in connection with the implementation of the Purpose.
  5. TERMS ON THE ORGANIZATION AND IMPLEMENTATION OF MM
    1. A Runner’s participation in MM, as well as the Runner’s running BIB (including the bib number and the official timing chip), is non-transferable and may not be assigned or transferred to any other party.
    2. The Organizer reserves the right to disqualify a Runner and/or cancel the Runner’s participation status (from the MM event) if the Runner provides incorrect data or information, or if, in the Organizer’s assessment, the Runner has consumed prohibited food, beverages, or medication in accordance with World Athletics regulations. In the event of such disqualification or cancellation, the Organizer shall not be obliged to refund any registration fees paid by the Runner.
    3. Any Runner who does not run at the time and at the location determined by the Organizer shall not be entitled to receive race results, including but not limited to a finisher medal and a finisher shirt (applicable exclusively to Runners in the Marathon category).
    4. The Runner is required to immediately cease participation in the MM event if instructed to do so by race officials, medical teams, the race director, referees, and/or security personnel or marshals.
    5. Pets and/or any wheeled transportation devices or objects, including but not limited to bicycles, wheelchairs (except wheelchairs and bicycles approved by the Organizer), skates, roller shoes, and similar equipment, are prohibited from being present on the running course during the MM event.
    6. The Runner is prohibited from running together with infants, children under the age of ten (10) years, and/or any third party who is not registered as a Runner.
    7. The Organizer is authorized to establish cut-off times at specific locations along the running course, referred to as checkpoints. Any Runner who fails to pass a checkpoint within the time limit determined by the Organizer is required to stop participating in the race and board the official transportation designated by the Organizer. Such official transportation shall transport the Runner to the finish line.
    8. The cut-off time (“COT”) for the Marathon category is 7 (seven) hours, the COT for the Half Marathon category is 3.5 (three point five) hours, and the COT for the 10K category is 2 (two) hours. All Runners must complete the race within the applicable COT for each category. Any Runner who completes the race beyond the applicable COT shall not be entitled to receive a medal (for all categories) and a finisher shirt (applicable exclusively to the Marathon category).
    9. Race winners, potential race winners, or their representatives may request clarification of race results or submit an objection within thirty (30) minutes after the race results are announced or after prizes are awarded, whichever occurs first.
    10. The Organizer reserves the right to conduct doping tests on Runners. The Organizer reserves the right to disqualify any Runner who is proven to have committed a doping violation.
  6. RUNNING COURSE
    1. The determination of the MM event location and the running course is the sole authority of the Organizer. The Organizer reserves the right to change the MM event location and/or the Course by providing prior notice to the Runners. In the event of a change to the Course, the Organizer shall not be obligated to refund the registration fee or any other costs incurred by the Runners.
    2. Any Runner who (i) fails to comply with directions, orders, or instructions issued by race officials, security personnel, or marshals (“Officials”), or (ii) engages in unsportsmanlike conduct, or (iii) commits verbal or physical abuse or violence against the Officials, may be disqualified from the race by the Officials.
    3. The Organizer reserves the right to disqualify any Runner who runs outside or not in accordance with the Course as determined by the Organizer.
    4. Any Runner who participates in the race without wearing the running BIB (including the bib number and the official timing chip) assigned to the Runner may be stopped and disqualified from the race. The Runner is required to wear the running BIB on the front of the Runner’s apparel.
    5. No person shall be permitted to be present on the Course except registered Runners or parties approved by the Organizer. Accordingly, no person may accompany a Runner on the Course unless such person is registered as a Runner or has obtained approval from the Organizer.Medical assistance provided by official MM medical personnel shall not be considered assistance that results in a Runner’s disqualification. If a Runner is in an unhealthy condition during or after the race and/or receives medical assistance from official MM medical personnel, the Runner is required to provide honest and detailed health information to the Organizer or to any party authorized by the Organizer.
  7. RUNNING BIB, OFFICIAL TIMING CHIP, AND BIB NUMBER
    1. All Runners shall receive a running BIB displaying the Runner’s bib number and affixed with an official timing chip. The Runner is required to wear the running BIB in accordance with the instructions and directions determined by the Organizer.
    2. Gun time is the standard used as the commencement of race time calculation.
    3. A Runner’s recorded time (net time) shall be determined based on the official timing chip, calculated from the moment the Runner crosses the starting line until the Runner crosses the finish line.
    4. The Runner is required to wear the official timing chip at all times during the race, starting from the starting line until crossing the finish line.
    5. Any Runner who uses more than one official timing chip shall be disqualified, and the recorded time shall not be deemed valid by the Organizer.
    6. The Organizer reserves the right to disqualify any Runner who loses the official timing chip.
    7. The Runner is required to start the race immediately after the gun time and within the maximum start time limit determined by the Organizer. The Organizer reserves the right to disqualify any Runner who starts the race before the gun time or after the maximum start time limit determined by the Organizer.
    8. The Runner is required to wear the running BIB throughout participation in the race.
    9. In the event of a technical error whereby the official timing chip cannot be detected, resulting in the Runner having no recorded time, the Organizer reserves the right to conduct a verification to determine the validity of such condition.
  8. TERMS AND CONDITIONS FOR RACE WINNERS AND PRIZE AWARDS
    1. The Runner is required to uphold sportsmanship, proper conduct, and to comply with all rules and requirements stipulated by the Organizer.
    2. Only Runners who are able to prove valid personal identification data that is consistent with their official identification documents (KTP/ Passport/ KITAS/ KIA, or other forms of identification approved by the Organizer) may be declared winners.
    3. Race winners shall be determined based on the fastest time calculated using gun time (fastest gun time), and not based on net time.
    4. A Runner’s status as a potential winner does not guarantee that the Runner will be declared a winner until the verification process has been completed by the Organizer.
    5. Race categories consist of Marathon, Half Marathon, 10K, Wheelchair, and Children Sprint, while race classes consist of Open, National, and National Master. Prizes shall be awarded to male and female winners for each respective Category and Class.
    6. The announcement of race results and the awarding of prizes shall be conducted at the podium and shall be made to the first, second, and third place winners.
    7. Only winners in the Marathon, Half Marathon, 10K, Wheelchair, and Children Sprint Categories shall be entitled to receive prizes after the verification process has been completed by the Organizer.
    8. Prizes shall be awarded in Indonesian Rupiah and shall be subject to applicable taxes and deductions in accordance with prevailing regulations.
    9. The Organizer reserves the right to conduct doping tests on Runners before, during, or after the race, in accordance with the provisions set by the Athletics Integrity Unit (AIU).
    10. If, based on a doping test, a Runner is declared positive for the consumption or use of prohibited substances, the Runner shall not be declared a winner. If race results have already been announced, the winner title shall be revoked and reassigned to the Runner with the next fastest recorded time in the same Category who meets the applicable requirements.
    11. If a doping test is conducted on a Runner, prizes shall only be awarded after the Runner has completed all required doping test procedures and an official negative result has been issued by the AIU.
    12. A Runner shall only be entitled to win in 1 (one) Category and 1 (one) Class. If a Runner wins in more than one Category or more than one Class, such Runner shall only be entitled to receive the highest prize value and winner title for 1 (one) Category or 1 (one) Class. The winner position relinquished in the other Category or Class shall be awarded to the Runner with the next fastest recorded time in such Category or Class.
    13. Prizes for winners in the Open Class may be awarded to foreign nationals, Indonesian citizens, or Indonesian citizens aged 40 years or above.
    14. Prizes for winners in the National Class may be awarded to Indonesian citizens or Indonesian citizens aged 40 years or above.
    15. Prizes for winners in the National Master Class may only be awarded to Indonesian citizens aged 40 years or above.
    16. No winner announcement shall be conducted for the National Master Class category.
    17. The Organizer’s decisions shall be final and binding and shall not be subject to appeal.
  9. BAG / BELONGINGS STORAGE FACILITY
    1. The Organizer shall provide a bag or belongings storage facility for Runners at a designated location and for a specified period of time. Runners are prohibited from depositing valuable items in the bag or belongings storage facility.
    2. The Organizer shall not be responsible or liable for the loss of any valuable items stored at the storage facility or for any loss or damage suffered by the Runner in connection with the use of the bag or belongings storage facility.
    3. If, upon the expiration of the maximum storage period, the Runner fails to retrieve his/her bag or belongings, the Organizer shall not be responsible for the security or safekeeping of the Runner’s bag or belongings.
  10. PHOTOGRAPHY AND DOCUMENTATION
    By participating in the MM event, the Runner grants consent to the Organizer to document the Runner’s participation in the MM event in the form of photographs and/or videos, and acknowledges that such documentation may be used by the Organizer as communication and publication materials in connection with the MM event and/or similar events in the future.
  11. AMENDMENTS TO MM TERMS AND CONDITIONS
    1. The Organizer reserves the right to make amendments and/or additions to the MM Terms and Conditions. In the event of any amendment and/or addition to the MM Terms and Conditions, the Organizer shall notify the Runners of such amendment and/or addition.
    2. The Runner shall be bound by all amendments and/or additions to the Terms and Conditions as determined by the Organizer.
    3. Any failure by the Runner to comply with the Terms and Conditions (including any amendments thereto) may result in the Runner’s disqualification, the invalidation of the Runner’s race results, and/or other consequences as determined by the Organizer.
  12. RELEASE AND WAIVER OF LIABILITY
    1. The Runner hereby waives, releases, and discharges the Organizer, agrees not to make any claim against the Organizer, and releases the Organizer and all parties associated with the Organizer from any and all liabilities, claims, actions, or losses that may arise from or be related to the Runner’s registration for or participation in MM.
    2. The Organizer, its subsidiaries/branches, directors, officers, employees, agents, partners, and licensees (World Athletics or PASI) shall not be responsible or liable for any immaterial or non-material losses, whether direct or indirect, including but not limited to loss of potential profits, damage to the reputation of any party, or any other non-material losses in connection with MM.
    3. Without prejudice to other provisions of these Terms and Conditions, the Runner hereby agrees that, in the event the Organizer is required to provide any compensation, the maximum amount of compensation payable by the Organizer shall be limited to the amount of money received by the Organizer from the Runner.
